1. Agreement to Terms

By creating an account, creating or publishing invitations, purchasing template access, or subscribing to passes on Digivite.in ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use our platform.

2. Eligibility & Account Responsibility

In accordance with the Indian Contract Act, 1872, you must be at least 18 years of age and competent to enter into a legally binding contract in India to register an account and purchase services. You agree to provide accurate registration information and are responsible for safeguarding your login credentials. Digivite reserves the right to suspend or terminate accounts that breach security guidelines or provide fraudulent data.

All commercial transactions on Digivite.in are denominated and billed in Indian Rupees (₹):

4. User Content & Intermediary Safe Harbor

You retain full ownership of the event photography, invitation wording, and audio files you upload. By publishing on Digivite, you grant us a limited license to render and host your invitation website (e.g., at https://digivite.in/i/{slug}).

Under Section 79 of the Information Technology Act, 2000, Digivite operates as an Intermediary and does not actively pre-screen user-uploaded media. You are solely responsible for ensuring that you possess the necessary rights and consents to use uploaded images and background audio tracks. We take down reported infringing content in accordance with our Copyright Policy.

5. Guest Data & Consent

When collecting guest attendance and headcount information, you act as the primary Data Fiduciary. You represent that you have obtained consent from your guests prior to gathering and managing their responses through Digivite.

6. Limitation of Liability & Disclaimers

Digivite is provided on an "as is" and "as available" basis. While we strive for 99.9% platform availability, we are not liable for disruptions resulting from telecommunication failures or third-party outages. To the maximum extent permitted by Indian law, our total cumulative liability is limited to the fees paid by you in the 12 months preceding any claim.

7. Governing Law & Jurisdiction

These terms and all contractual relationships shall be governed by and interpreted under the laws of India. Any legal action or dispute arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
